Terms of Service

    Effective date: January 1, 2026
    Last updated: January 1, 2026

These Terms of Service ("Terms") govern your use of tinytiffins.com and your interactions with Tiny Tiffins LLC ("Tiny Tiffins," "we," "us," or "our").

By using this website, submitting a form, or requesting services, you agree to these Terms. If you do not agree, do not use the website.

    1. About Tiny Tiffins

Tiny Tiffins provides meal programs to schools, preschools, daycare centers, camps, and other childcare organizations in the San Francisco Bay Area.

Information on this website is intended primarily for adults, including school administrators, childcare professionals, parents, guardians, and prospective organizational partners. The website is not intended for independent use by children.

    2. Website Information

We aim to keep website information accurate and current. However, menus, ingredients, availability, delivery areas, prices, schedules, dietary options, and program features may change.

Website content is provided for general information and does not constitute a binding service commitment unless expressly incorporated into a signed agreement or confirmed order.

    3. Quotes, Tastings, and Service Agreements

Submitting a contact, quote, or tasting request does not create a contract or guarantee service availability.

Meal services for a school, preschool, daycare center, camp, or other organization may be governed by a separate proposal, service agreement, order form, or written confirmation. If that document conflicts with these Terms, the separately executed agreement controls for the applicable services.

Service availability may depend on factors including location, delivery routes, kitchen capacity, operating schedule, minimum order volume, dietary requirements, and the organization's facilities.

    4. Ordering and Authorized Information

You agree to provide accurate, complete, and current information. You may submit information about a child only if you are the child's parent or legal guardian or are otherwise authorized by the applicable parent, guardian, school, or childcare organization.

Schools and childcare organizations are responsible for communicating ordering procedures, deadlines, schedule changes, student information, allergy information, and other program requirements to their communities unless a written agreement assigns that responsibility to Tiny Tiffins.

    5. Menus, Ingredients, and Substitutions

Menus may rotate and are subject to ingredient availability, seasonal changes, supply disruptions, safety considerations, and operational needs.

We may make reasonable substitutions when necessary. We will endeavor to maintain the general nature and dietary designation of a meal, but photographs and descriptions are illustrative and actual meals may vary.

Ingredients and recipes may change. Parents, guardians, schools, and childcare organizations should review current information rather than relying on a previous menu or ingredient list.

    6. Food Allergies and Dietary Requirements

Food allergies and dietary requirements must be communicated through the process designated by Tiny Tiffins and the applicable school or childcare organization. Information must be accurate, complete, and updated promptly whenever a child's needs change.

Tiny Tiffins will use reasonable care to follow dietary instructions we have accepted. However, unless expressly confirmed in writing, our facilities and suppliers may handle common allergens, and we cannot guarantee that any meal or environment is completely free from allergens or cross-contact.

A Tiny Tiffins meal program is not medical care. Parents and guardians remain responsible for determining, in consultation with qualified healthcare professionals where appropriate, whether a meal is suitable for their child.

Schools and childcare organizations remain responsible for supervision, emergency-response procedures, prescribed medication, and compliance with their own health and safety obligations unless otherwise established in a written agreement.

In an emergency, contact emergency services rather than relying on this website, email, or a Tiny Tiffins contact form.

    7. Delivery and Service Interruptions

Delivery times are estimates unless expressly guaranteed in a written agreement. Delays, substitutions, or interruptions may occur because of traffic, weather, emergencies, school closures, power outages, supply disruptions, government actions, labor issues, or other circumstances outside our reasonable control.

The applicable school or organization must provide safe and timely access to an authorized delivery location and identify personnel authorized to receive meals.

Specific remedies for missed or delayed service will be governed by the applicable service agreement or written ordering policy.

    8. Pricing, Billing, Cancellations, and Refunds

Prices, payment schedules, minimums, taxes, fees, cancellation deadlines, credits, and refund eligibility will be stated in the applicable quote, ordering system, invoice, service agreement, or written policy.

Unless required by law, submitting a general inquiry does not entitle a user to service, a particular price, or a refund.

If a school or third-party ordering provider administers payment or cancellation requests, its additional terms may apply.

    9. Acceptable Use

    You may not:

    • Use the website for an unlawful, fraudulent, or harmful purpose.
    • Submit information you are not authorized to provide.
    • Impersonate another person or misrepresent your affiliation.
    • Attempt to gain unauthorized access to the website or related systems.
    • Introduce malicious code or interfere with website operation.
    • Scrape, copy, or commercially exploit website content without permission.
    • Use the website to harass others or infringe their rights.

We may restrict access or take other appropriate action if we reasonably believe these Terms have been violated.

    10. Intellectual Property

The website and its text, graphics, branding, photographs, menus, designs, logos, and other content are owned by Tiny Tiffins or used with permission and are protected by applicable intellectual-property laws.

Tiny Tiffins grants you a limited, revocable, nonexclusive, nontransferable right to use the website for personal or internal organizational evaluation of our services.

You may not reproduce, modify, distribute, publish, sell, license, or commercially exploit website content without prior written permission, except as allowed by law.

    11. Feedback and Testimonials

If you send suggestions or general feedback, you authorize Tiny Tiffins to use that feedback to improve our services without compensation or obligation to you.

We will obtain appropriate permission before publicly identifying you, your child, or your organization in a testimonial, photograph, case study, or promotional statement.

    12. Third-Party Services and Links

The website may link to third-party ordering platforms, payment providers, social networks, maps, or other services. Tiny Tiffins does not control those services and is not responsible for their content, availability, security, or practices.

Your use of a third-party service may be subject to that provider's own terms and privacy policy.

    13. Disclaimer of Warranties

To the fullest extent permitted by law, the website is provided on an "as is" and "as available" basis. Tiny Tiffins disclaims implied warranties concerning the website, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

Nothing in these Terms excludes warranties or obligations that cannot legally be excluded. Any warranties applicable to meal services may be stated in the relevant service agreement.

    14. Limitation of Liability

To the fullest extent permitted by law, Tiny Tiffins will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the website.

Tiny Tiffins' total liability arising solely from use of the website will not exceed one hundred U.S. dollars ($100).

These limitations do not apply where prohibited by law, and they do not limit obligations or remedies expressly established in a separate written service agreement.

    15. Indemnification

To the extent permitted by law, you agree to indemnify and hold Tiny Tiffins and its officers, employees, and agents harmless from third-party claims arising from information you submit without authorization, your unlawful misuse of the website, or your material violation of these Terms.

This provision does not require indemnification for conduct for which indemnification cannot legally be required.

    16. Privacy

Our collection and use of personal information are described in the Tiny Tiffins Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

    17. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Before filing a legal claim concerning the website, you and Tiny Tiffins agree to make a good-faith effort to resolve the matter informally by providing written notice and allowing 30 days for a response.

Unless applicable law requires otherwise or a separate written agreement states otherwise, legal proceedings concerning these Terms will be brought in a state or federal court with jurisdiction in the California county where Tiny Tiffins maintains its principal place of business.

    18. Changes to These Terms

We may revise these Terms periodically. Updated Terms will be posted on this page with a revised "Last updated" date.

Changes apply prospectively from their effective date. Continued use of the website after that date constitutes acceptance of the revised Terms.

    19. General Provisions

If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our written permission. Tiny Tiffins may transfer these Terms as part of a merger, reorganization, financing, acquisition, or sale of assets.

These Terms, together with the Privacy Policy and any applicable written service agreement, constitute the applicable agreement concerning your use of the website.
